Each person who is employed by the BoM for a period of one month or more of continuous service must have a written statement of terms and conditions of employment and s/he must receive this within 2 months of the start of employment. While strictly speaking, a written statement of terms and conditions of employment does not have to be in the format of a contract, most employers use written contracts of employment.
The difference between a written contract and a written statement of terms and conditions of employment is that the contract is signed by both parties whereas a written statement can simply be furnished by the employer to the employee without the employee having to sign it. In addition a written contract is generally more detailed. Template contracts are available below for permanent and temporary staff
There are two categories of contract for temporary employees: (1) fixed term and (2) specified purpose. It is important to ensure that the correct form of contract is used.
(1) A fixed term contract should be used when the employer is certain of the duration of the contract i.e. the permanent employee is out for a definite period of time. For example, if a permanent teacher is on career break, it is clear that s/he will not be returning to work during the course of the year and accordingly a fixed term contract is the appropriate one to use.
(2) A specified purpose contract should be used where it is not certain when the permanent employee will return to work i.e. the permanent employee is on maternity leave, sick leave, carers leave etc.
